ESM Files Suit Against BIOVA to Protect Its Patented Process for Producing NEM®

ESM Technologies, LLC announced today that it has filed suit against Biova, LLC in the Federal District Court for the Missouri Western District for infringement of the company’s U.S. patent covering the production of NEM® (Natural Eggshell Membrane).  ESM alleges that Biova’s manufacture and sales of BiovaFlex™, BiovaDerm™, and BiovaPlex™ literally infringe its U.S. Patent, and that Biova’s principals, employees, or consultants have engaged in misappropriation of trade secrets, tortious interference, and other willful and deliberate acts. ESM Technologies will continue to vigorously enforce its intellectual property rights to stop unlawful activities, including those committed by Biova.

Specifically, ESM Technologies, LLC of Carthage, Missouri, filed suit against Biova, LLC of Johnston, Iowa, for infringement of ESM Technologies’ patent, U.S. Patent No. 6,946,551, which covers processes for producing a hyaluronic acid rich fraction from eggshell membrane. The patented process which is used to produce NEM® (Natural Eggshell Membrane), was discovered and developed by ESM Technologies. ESM Technologies alleges that Biova’s manufacture and sales of BiovaFlex.
